Terms of Service
Last updated: [DATE — fill in on publish]
These Terms of Service ("Terms") govern your use of DevTrac, a device location tracking and recovery service operated by [LEGAL ENTITY NAME] ("DevTrac", "we", "us"). By creating an account, you agree to these Terms.
1. Who can use DevTrac
You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create an account.
2. Authorized use only — this is the most important section
DevTrac may only be installed on a device that you personally own, or on a device you have explicit, informed authorization from the device's primary user to install tracking software on. By registering a device, you represent and warrant that:
- you own the device, or
- you have obtained clear, informed consent from the person who primarily uses the device before installing DevTrac on it.
You may never use DevTrac to track, locate, lock, or wipe a device belonging to another adult without their knowledge and consent — including a spouse, partner, ex-partner, roommate, or employee. Using DevTrac in this way may violate wiretapping, stalking, computer-crime, or data-protection laws in your jurisdiction, and is grounds for immediate account termination without refund. We cooperate with law enforcement investigations into suspected misuse.
A parent or legal guardian may install DevTrac on a minor child's device without the child's separate consent.
3. Subscriptions and billing
New accounts receive a 7-day trial with no payment method required. Paid plans (Pro, Family) bill on a recurring monthly basis via our payment processor, Flutterwave, and continue automatically until you cancel from the billing page. You can cancel at any time; access continues until the end of the current billing period. Fees are non-refundable except where required by law.
4. Remote lock, wipe, and alarm — irreversible actions
The remote wipe feature permanently erases data on the target device with no ability to undo it. DevTrac is not responsible for data loss resulting from your use of this feature. You are solely responsible for confirming a device is actually lost or stolen before issuing a lock, wipe, or alarm command. Location accuracy, and the delivery of any command, depends on the device's connectivity, battery, and operating system behavior, and is not guaranteed.
5. Acceptable use
You won't attempt to interfere with DevTrac's infrastructure, reverse engineer the service to bypass billing or device limits, or use the service for any unlawful purpose.
6. Disclaimer of warranties
DevTrac is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that a lost or stolen device will be recovered.
7. Limitation of liability
To the maximum extent permitted by law, DevTrac and its officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of the device, or loss of profits, arising from your use of the service. Our total liability for any claim will not exceed the amount you paid us in the twelve months preceding the claim.
8. Indemnification
You agree to indemnify and hold harmless DevTrac and its officers, employees, and affiliates from any claim, damage, loss, or expense (including reasonable legal fees) arising from: (a) your use of the service in violation of these Terms, including Section 2 above; (b) your violation of any law or the rights of a third party; or (c) content or data you submit through the service.
9. Termination
We may suspend or terminate your account for violation of these Terms, including any use that reasonably appears to be non-consensual tracking of another person. You may close your account at any time from account settings.
10. Governing law
These Terms are governed by the laws of [JURISDICTION — fill in on publish].
11. Changes to these Terms
We may update these Terms from time to time. Continued use of DevTrac after a change constitutes acceptance of the updated Terms.
